This Cookie Policy explains how The Gear Project LLC ("The Gear Project," "we," "us," or "our") uses cookies and similar tracking technologies on our website at www.thegearproject.com and mobile application (collectively, the "Service"). This Cookie Policy supplements our Privacy Policy (www.thegearproject.com/privacy) and Terms of Service (www.thegearproject.com/terms), both of which are incorporated herein by reference. In the event of a conflict between this Cookie Policy and the Privacy Policy, the Privacy Policy controls.
By using the Service, you consent to the use of cookies as described in this Cookie Policy. If you do not accept cookies, some features of the Service may not function correctly.
1. What Are Cookies?
Cookies are small text files placed on your device (computer, phone, or tablet) when you visit a website. They are widely used to make websites work, improve efficiency, and provide information to site operators. Cookies can be:

2.1 Strictly Necessary Cookies
These cookies are essential for the Service to function and cannot be disabled. They enable core features such as user authentication, account security, shopping cart functionality, and checkout. Without these cookies, the Service cannot be provided.

2.3 Analytics Cookies
These cookies collect information about how visitors use the Service, such as which pages are visited most often and how users navigate between pages. This data is used in aggregate to improve the Service. Analytics cookies do not collect information that directly identifies you, though they may use pseudonymous identifiers linked to your device.

2.4 Affiliate Attribution Cookies
These cookies track whether you arrived at the Service via a link from one of our Affiliate Partners — including influencers and content creators participating in our affiliate program through the RockPorch outdoor affiliate marketplace and the Avantlink affiliate network. If you complete a purchase after clicking an affiliate link, transaction confirmation data (order ID and amount) is shared with the affiliate network to calculate commissions. These cookies do not share your name, email address, payment information, or other personally identifying details with Affiliate Partners.

- Data collected: Referral source, click timestamp, transaction confirmation (if purchase completed)
- Can be opted out: Yes — see Section 5. Note: Opting out of affiliate tracking does not affect your ability to use the Service or purchase items; it only means that an Affiliate Partner may not receive credit for referring you.
2.5 Advertising and Remarketing Cookies
These cookies are used to show you relevant advertisements for The Gear Project's products and services on other websites and platforms after you have visited our Service. They may be used to build a profile of your interests and show targeted ads on third-party sites. These cookies are set by our advertising partners, not by The Gear Project directly.

- Data collected: Browsing activity, device identifiers, ad interaction data

2.6 Transactional and Communication Cookies
These cookies and related technologies support transactional and communications functions on the Service, including email delivery tracking associated with order confirmations, shipping notifications, and marketing communications.
- Set by: Sharetribe for transactional email, Beehiiv for marketing email
- Data collected: Email open/click tracking (via pixel), delivery status
- Can be opted out: Yes — you may unsubscribe from marketing emails at any time. Transactional email tracking (order confirmations, shipping notices) cannot be disabled as it is required for order fulfillment.

4. Arizona-Specific Disclosures
The Gear Project is domiciled in the State of Arizona and is subject to Arizona law, including the Arizona Revised Statutes. There is currently no Arizona-specific cookie consent law separate from the general data security and breach notification framework.
Cookie and tracking data collected by The Gear Project is treated as personal information subject to Arizona's data breach notification law (A.R.S. §§ 18-551 and 18-552). In the event of a security breach involving cookie-derived data that includes personally identifying information, The Gear Project will notify affected Arizona residents as required by law. See the Security section of the Privacy Policy for full breach notification procedures.

5. California-Specific Disclosures
The Gear Project is subject to California consumer privacy law, including the California Consumer Privacy Act (CCPA), because it conducts business with California residents and has California-domiciled majority members. The following disclosures apply specifically to California residents.
5.1 Cookies as a "Sale" of Personal Information Under CCPA
The CCPA defines "sale" broadly to include sharing personal information with third parties for valuable consideration, which may include non-monetary consideration such as receiving advertising services. The following cookie activities may constitute a "sale" of personal information under the CCPA:
- Advertising and remarketing cookies set by Google, Meta, and Pinterest that share device identifiers and browsing data with those platforms for targeted advertising purposes.
- Affiliate attribution cookies that share transaction confirmation data with Avantlink/RockPorch in exchange for referral traffic from Affiliate Partners.
California residents have the right to opt out of these activities. See Section 6 below.
5.2 CalOPPA Disclosure
Under the California Online Privacy Protection Act (CalOPPA), The Gear Project discloses that third parties may use cookies or web beacons on the Service to collect information about your online activities over time and across different websites. The Gear Project does not currently alter its data collection practices in response to browser Do Not Track (DNT) signals because no uniform standard for honoring DNT signals has been established. We will update this policy if such a standard is adopted.
5.3 California Consumer Rights Regarding Cookies
California residents have the following rights in connection with cookie-based data collection:
- Right to Know: You may request information about the categories of personal information collected via cookies and how it is used or shared.
- Right to Delete: You may request deletion of personal information collected via cookies, subject to certain exceptions.
- Right to Opt Out of Sale: You may direct us to stop sharing your data with advertising and affiliate partners in ways that constitute a "sale" under the CCPA.
- Right to Non-Discrimination: You will not receive a different level of service for exercising these rights.

5.4 Notice to California Residents

6. How to Manage and Opt Out of Cookies
6.1 Browser-Level Cookie Controls
Most web browsers allow you to control cookies through their settings. You can set your browser to refuse cookies, delete existing cookies, or alert you when cookies are being set. Instructions vary by browser:
- Google Chrome: Settings > Privacy and Security > Cookies and other site data
- Safari: Preferences > Privacy
- Mozilla Firefox: Options > Privacy & Security > Cookies and Site Data
- Microsoft Edge: Settings > Cookies and site permissions
Note: Disabling strictly necessary cookies will prevent some or all features of the Service from functioning correctly, including login, checkout, and seller payouts.
6.2 Analytics Opt-Out
To opt out of Google Analytics tracking across all websites, install the Google Analytics Opt-out Browser Add-on, available at tools.google.com/dlpage/gaoptout. This prevents the Google Analytics JavaScript from sharing information about your visit activity with Google Analytics.
6.3 Advertising and Remarketing Opt-Out
You may opt out of interest-based advertising from our advertising partners through the following industry opt-out tools:
- Network Advertising Initiative (NAI): networkadvertising.org/choices
- Digital Advertising Alliance (DAA): optout.aboutads.info
- Google Ads Settings: adssettings.google.com
- Meta Ad Preferences: facebook.com/ads/preferences
- Pinterest Ad Settings: pinterest.com/settings/privacy
On mobile devices, you can limit ad tracking through your device settings:
- iOS: Settings > Privacy & Security > Tracking > turn off "Allow Apps to Request to Track"
- Android: Settings > Google > Ads > Opt Out of Ads Personalization
Note: These opt-outs are browser- and device-specific. If you use multiple browsers or devices, you will need to opt out on each one separately. Opting out does not mean you will stop seeing ads from The Gear Project — it means the ads you see will not be tailored to your browsing behavior.
6.4 Affiliate Attribution Opt-Out
If you do not wish to have your referral source tracked by Avantlink for affiliate commission purposes, you may opt out through your browser cookie settings or by visiting Avantlink's privacy page at avantlink.com. Opting out of affiliate attribution does not affect your ability to purchase items on The Gear Project or the price you pay.
6.5 Email Tracking Opt-Out
Marketing emails from The Gear Project include an unsubscribe link at the bottom of each message. You may also unsubscribe by contacting us at team@thegearproject.com. Transactional emails (order confirmations, shipping notifications, dispute notices) cannot be opted out of while your account is active, as they are necessary to fulfill your transactions.
6.6 Do Not Track (DNT) Signals
Some browsers offer a Do Not Track (DNT) feature that sends a signal to websites requesting that your browsing not be tracked. Because no uniform standard for honoring DNT signals exists, The Gear Project does not currently alter its practices in response to DNT signals. This disclosure is made pursuant to California's CalOPPA requirements.
7. Third-Party Cookies and Links
The Service may contain links to third-party websites, including websites operated by our Affiliate Partners. Once you leave The Gear Project's website, this Cookie Policy no longer applies. Third-party websites have their own cookie and privacy policies, and we encourage you to review them before providing any personal information. The Gear Project is not responsible for the privacy practices or cookie use of any third-party website.
8. Cookie Retention Periods
The length of time a cookie remains on your device depends on the type of cookie:
- Session cookies are deleted when you close your browser.
- Authentication and functional cookies typically persist for 30 days or until you log out, whichever comes first.
- Analytics cookies (Google Analytics 4) persist for up to 13 months by default.
- Affiliate attribution cookies (Avantlink) typically persist for 30–90 days, depending on the affiliate program configuration.
- Advertising/remarketing cookies vary by platform, typically 30–180 days.
You may delete cookies at any time using your browser settings. Note that deleting cookies may log you out of the Service and reset your preferences.
9. Changes to This Cookie Policy
We may update this Cookie Policy from time to time to reflect changes in our practices or applicable law. When we make material changes, we will update the Effective Date at the top of this document and provide notice through the Service or by email. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Cookie Policy.
